TERMS OF USE

1. Introduction

The use of this website www.lottox.org and/or the mobile application named Lottox (hereinafter referred to as "Lottox") is governed by these Terms of Use including the Privacy Policy available at (click here) and any other disclaimers and terms published on Lottox (together referred to as "Terms"). These Terms constitute a valid and binding agreement between AARNANEX DIGITAL PRIVATE LIMITED ("Platform Owner" / "we" / "us") and you. These Terms are binding upon Platform Owner and You, and govern your use of the offerings, services, and tools provided by Lottox (collectively referred to as "Services").

a. This document is an electronic record in terms of the Information Technology Act, 2000 and applicable rules, and is generated by a computer system without requiring any physical or digital signatures. b. By visiting, accessing, or using Lottox:

i.  You acknowledge that you have read, understood, and agreed to the Terms and that these Terms are binding on you;
ii.  You confirm that you are legally competent under Indian law to agree to and be bound by these Terms;
iii.  You agree to provide true, accurate, and complete information during registration and while using the Services;
iv.  You understand that your use of the Platform and Services is at your own risk, and the Platform Owner is not liable for any loss, damages, or inaccuracies arising from the use of the Platform;
v.  You agree not to use the Platform or Services for any unlawful purpose or in violation of applicable laws;
vi.  You acknowledge that the content, design, and materials of the Platform are proprietary and licensed to the Platform Owner and that unauthorized use may lead to legal action;
vii.  You agree to pay applicable charges for using the Services as specified on the Platform;
viii.  You understand that the Platform may contain links to third-party websites, and access to such websites is governed by the terms and policies of those third parties;
ix.  You shall indemnify and hold harmless the Platform Owner, affiliates, and employees from any claims arising from your violation of these Terms or applicable laws;
x.  The Terms are governed by Indian law, and all disputes are subject to the exclusive jurisdiction of the courts in India.

2. Updates / Modifications to the Terms

a. Kindly review these Terms periodically. The Terms may be updated or modified at any time, for any reason, at the sole discretion of AARNANEX DIGITAL PRIVATE LIMITED. Such updates or modifications will become effective immediately upon posting on the Lottox Platform. The date of the Terms will accordingly be updated on the Platform, and you may also be informed of the updates or modifications via a notification upon logging in or accessing the Platform.
b. Your continued use of the Lottox Platform following the posting of the updates or modifications to the Terms will be deemed to be your acceptance of the revised Terms.

3. User Registration

a. Offerings on Lottox are offered exclusively to the Platform Owner's network of registered users ("Users") and are not open to unregistered users.
b. When you register an account on Lottox:

i.    You agree to provide true, accurate, and complete information for the purpose of registration, (e.g., name, mobile number, email address, and other contact details as may be required);
ii.   You understand that any information provided as part of such registration, or otherwise collected, is governed by and subject to the terms of the Privacy Policy;
iii.  You will need to select a unique username and password to set up your user account;
iv.   You will receive a one-time password (OTP) on the contact number provided by you for verification purposes;
v.    You understand that a User account ("User Account") is successfully created only upon verification of your mobile number via the OTP verification process;
vi.   You understand that from time to time, you may be provided with additional codes or passwords necessary to access and use certain offerings, features, or functions of Lottox;
vii.  You undertake that you shall maintain only one User account and not multiple accounts registered with Lottox;
viii. You undertake not to share your User account details, such as username and password, with any other person for their use of Lottox;
ix.   You agree to receive periodic SMS alerts and newsletters from AARNANEX DIGITAL PRIVATE LIMITED, including for offers and promotions;
x.    You agree to notify AARNANEX DIGITAL PRIVATE LIMITED immediately if you become aware of or suspect any unauthorized use of your username and/or password, or if you feel any need to deactivate your User account due to security concerns.

c. If you have any security-related concerns, please contact Support at [link]. AARNANEX DIGITAL PRIVATE LIMITED reserves the right to disclose any information about Users, including their registration data, to comply with applicable laws and/or requests from regulatory authorities or courts, and to safeguard the interests of its Users.

4. Use of Lottox

a. There shall be no general right for any person to purchase any Offerings on Lottox. No Offerings may be purchased by or Prize Money paid to:

i.    Minors, whether acting on their own behalf or on behalf of another person;
ii.   Directors, employees, and relatives of persons associated with Lottox;
iii.  Any person whose User Account has been suspended or terminated;
iv.  Any person who is not permitted to use or access Lottox in the State in which they are located;
v.   Any other persons or category of persons as mandated by AARNANEX DIGITAL PRIVATE LIMITED or applicable laws from time to time.

b. You should not use Lottox:

i.    for any purpose that is unlawful, illegal, or forbidden by law;
ii.   in any manner that harms AARNANEX DIGITAL PRIVATE LIMITED or its directors, employees, affiliates, distributors, partners, service providers, and/or any other User;
iii.  to remove any copyright or proprietary notices contained in any content on Lottox or in relation to the Offerings;
iv.  to copy, decompile, reverse engineer, or otherwise attempt to discover any source code, sell, assign, or otherwise transfer any intellectual property in Lottox or in relation to the Offerings;
v.   to send communications containing unsolicited or unauthorized advertisements, promotions, or marketing material;
vi.  in any manner other than as permitted under these Terms.

c. Use of the Offerings is only available to Users located in States where the sale and/or purchase of Offerings is permissible under the relevant State and central lottery laws. If you provide false information during registration on Lottox or while availing any Offerings, AARNANEX DIGITAL PRIVATE LIMITED reserves the right to terminate your membership and initiate legal proceedings at its discretion. In any event, Lottox shall not be liable to you if you access, attempt to register from a different State, or provide false information for the purposes of accessing, registering, or using the Platform.

5. Transaction History

a.  Users may obtain details of past transactions, including recharge of the User Wallet, withdrawal of amounts from the User Wallet ("Transaction History") on Lottox.
b.  AARNANEX DIGITAL PRIVATE LIMITED will make up to 30 days of Transaction History readily available.
c.  If you wish to obtain a complete record of your Transaction History beyond 30 days, you may contact AARNANEX DIGITAL PRIVATE LIMITED at lottoxindia@gmail.com. The requested information will be made available as soon as reasonably practicable.

6. Lotteries

a.  Each Lottery will be conducted and organised by the concerned State Government. Your participation in each Lottery and the organisation and conduct of the Lotteries is subject to the terms and conditions (including statutes and rules) of the related Lottery ("Lottery Laws") made available on Lottox at Clause 1b(iv), which you agree to independently review and comply with. To the extent of any conflict or inconsistency, the Lottery Laws will take precedence over these Terms and the Privacy Policy.
b.  Following each draw for any Lottery ("Lottery Draw"), the State Government will publish the final and conclusive winners in accordance with the applicable Lottery Laws ("Lottery Results"). The Results will be declared in the form of winning combination of numbers/alphanumeric, in accordance with the relevant Lottery Laws ("Winning Number"). AARNANEX DIGITAL PRIVATE LIMITED will announce the official Lottery Results on Lottox as soon as commercially possible following official publication by the relevant State Government.
c.  You agree that verification of Lottery Results from the relevant official publication of the concerned State Government is solely your responsibility. AARNANEX DIGITAL PRIVATE LIMITED is not liable for inaccurate announcement of the Lottery Result on Lottox.

7. Purchase of Lottery Tickets & Related Taxes

a.  Once registration is complete, the User shall have the ability to top up their account with money for purchase of Lottery Tickets on Lottox ("User Wallet").
b.  The price for each Lottery Ticket displayed on Lottox is determined by the State Government responsible for organising the Lottery.
c.  Once a User purchases a Lottery Ticket on Lottox, Lottox will print a physical copy of the Lottery Ticket in accordance with the relevant Lottery Laws and provide it to the User free of charge.

8. Prize Money

a. A User who has purchased and holds a Lottery Ticket bearing the Winning Number ("Winner") is responsible to claim the prize money as declared by the relevant State Government ("Prize Money") in the manner prescribed in Clause 8b below.
b. The process for claiming the Prize Money will differ depending on the amount of Prize Money in a single Lottery Ticket:

i. For Prize Money up to INR 10,000:

1. The amount will be automatically credited by AARNANEX DIGITAL PRIVATE LIMITED to the User Wallet of the Winner upon verification of the Lottery Ticket. Users may use this amount to avail the Offerings on Lottox.
2. Users may also transfer Prize Money up to INR 10,000 per day to their personal bank account;

ii. For Prize Money above INR 10,000:

1.  Payment of Prize Money will be routed through respective State Government procedures as specified in the Lottery Laws;
2.  Winner is responsible to inform AARNANEX DIGITAL PRIVATE LIMITED that they hold a Lottery Ticket bearing the Winning Number by contacting us via e-mail at lottoxindia@gmail.com ("Notice"). Upon receipt of Notice, Lottox will verify the Lottery Ticket.
3.  Winner must submit hard copies of the following documents ("Documents") to the office designated by the relevant State Government under the Lottery Laws for processing the payment of Prize Money:

i.    Physical Ticket;
ii.    Claim form in Government-approved format available at (click here)
iii.    Declaration on Rs.100/- stamp paper with notary in Government-approved format, available at (click here);
iv.    Four passport size photographs for declaration;
v.    Self-attested photocopy of residential proof (Aadhar card/passport);
vi.    Self-attested photocopy of PAN card;
vii.   Bank account details;
viii.   Cancelled cheque;
ix.    Self-attested photocopy of winning ticket;
x.    Any other information required by the State Government for processing of the Prize Money.

c. You agree to provide true and accurate information and Documents. You agree to cooperate with AARNANEX DIGITAL PRIVATE LIMITED by providing Documents in a timely manner. Under no circumstances shall Lottox and/or the State Government have any obligation to release the Prize Money if you provide false information and/or Documents or fail to provide the requisite Documents for the purpose of this Clause.

9. Payment and Taxes

a.  Refunds: A User will be entitled to a refund in case a Lottery Draw is cancelled by the relevant State Government. In such cases, the refunded amount will automatically be deposited to the User Wallet.
b.  Users may transfer up to INR 10,000 of Prize Money from their User Wallet per day;
c.  All payments of Prize Money above INR 10,000 made by the relevant State Government shall be subject to deduction of tax ("TDS") as per the Income Tax Act, 1961. Users will be provided TDS certificates in respect of such deductions by the relevant State Government. AARNANEX DIGITAL PRIVATE LIMITED shall not be liable for TDS deductions or certificates. Winners are responsible for payment of any other applicable taxes, including but not limited to income tax, in respect of the Prize Money.
d.  Payment of GST will be done in accordance with Notification No. 04/2017 - Integrated Tax (Rate), 04/2017 - Central Tax (Rate), issued by Ministry of Finance, Government of India ("Notification") while it remains in effect, and thereafter in accordance with any superseding notification/law.

10. Intellectual Property

a. Rights of AARNANEX DIGITAL PRIVATE LIMITED

i.  All intellectual property in the Lottery Tickets including any trademarks, logos, images and other content on the Lottery Tickets sold on Lottox belongs to the relevant State Government organising the Lottery. Your purchase of the Lottery Tickets does not grant you any proprietary rights in such intellectual property;
ii.  All intellectual property including software, techniques, processes, trademarks, logos, images, and other content available on Lottox belongs exclusively to AARNANEX DIGITAL PRIVATE LIMITED and/or its licensors. Your use of Lottox does not grant any proprietary rights in such intellectual property;
iii.  AARNANEX DIGITAL PRIVATE LIMITED and/or its licensors assert all proprietary rights in the trademarks and copyright depicted on Lottox. Any unauthorized use of these trademarks or copyright in connection with other goods, services, or offerings may constitute infringement and is actionable under applicable laws.

b. Rights of User

i. AARNANEX DIGITAL PRIVATE LIMITED grants you a limited, royalty-free right for personal and non-commercial use of Lottox, for as long as you are a registered User;
ii. Unless explicitly stated or authorized by AARNANEX DIGITAL PRIVATE LIMITED, you agree not to reproduce, modify, sell, distribute, mirror, frame, republish, download, transmit, or create derivative works of content on Lottox. You must not remove or modify any copyright, trademark, or ownership notices.

11. Confidential Information

You acknowledge and agree that certain information available on Lottox may be designated as confidential by AARNANEX DIGITAL PRIVATE LIMITED, and you will not disclose such confidential information to any third party without prior written consent or authorization.

12. Third Party Sites / Content

a.  Lottox may provide links or direct you to third-party websites. Using such links may redirect you to external sites.
b.  Visiting any external link is at your own risk. AARNANEX DIGITAL PRIVATE LIMITED does not endorse such websites or the information, products, or services offered therein. We are not responsible for the accuracy, timeliness, or completeness of information obtained from third parties and posted on Lottox.
c.  Display of third-party goods/services on Lottox does not imply sponsorship, endorsement, or approval by AARNANEX DIGITAL PRIVATE LIMITED.
d.  Use of third-party links is governed by separate agreements between you and the third party. AARNANEX DIGITAL PRIVATE LIMITED will not be liable for any acts, omissions, errors, breaches, or damages resulting from your interaction with third-party sites or services.

13. User Account Suspension and Deactivation

a. Suspensions of User accounts by AARNANEX DIGITAL PRIVATE LIMITED
AARNANEX DIGITAL PRIVATE LIMITED may suspend your User account, preventing access to Lottox offerings. Relevant user data may be shared with authorities, regulators, or courts to comply with applicable laws. Suspensions may occur if there is reason to believe your account is used for:

i.    Fraud or attempts to defraud;
ii.    Money laundering;
iii.    Collusion, rigging, or cheating;
iv.    User is under 18 years of age;
v.    User is in a jurisdiction where Lottox use is illegal;
vi.    Access from prohibited territories;
vii.   Violation of these Terms.

b.  If investigations are ongoing, the account may remain suspended.
c.  AARNANEX DIGITAL PRIVATE LIMITED reserves the right to suspend your User account at any time and take civil or criminal action in case of violations.
d.  Upon suspension, your right to use Lottox and access offerings immediately ceases. AARNANEX DIGITAL PRIVATE LIMITED is not liable for claims or damages arising from suspension.
e.  Deactivation of User account by You
You may deactivate your account anytime by emailing lottoxindia@gmail.com from your registered email. Deactivation requires withdrawing all wallet balances and ensuring no pending Lottery Ticket claims. To resume, reactivate the account by emailing lottoxindia@gmail.com.

14. Termination/Suspension of Offerings

AARNANEX DIGITAL PRIVATE LIMITED may terminate, vary, or suspend Lottox offerings immediately and without prior notice for the following reasons:

i.    For repair, maintenance, upgrade, or update of Lottox;
ii.    If Lottox ceases to provide offerings on behalf of Skill Lotto;
iii.  For any other reason at AARNANEX DIGITAL PRIVATE LIMITED's sole discretion.

15. Rights & Reservations

a. We reserve the right to:

i.    Make all decisions in relation to, inter alia, your registration with AARNANEX DIGITAL PRIVATE LIMITED;
ii.   Give you a username, different from the username chosen by you, if it impersonates an already existing username, or if AARNANEX DIGITAL PRIVATE LIMITED feels it is otherwise inappropriate;
iii.  Request additional documents and information from you for the purpose of your registration as a User with Lottox;
iv.  Deny access to Lottox or any portion thereof without notice for the following reasons: (a) any unauthorized access or use by you; (b) attempts to assign or transfer any rights granted under these Terms; (c) violation of any provisions of these Terms or applicable laws.

16. Liability Disclaimer

a.  We exclude all representations and warranties relating to Lottox, including content therein, and the Offerings on Lottox. AARNANEX DIGITAL PRIVATE LIMITED disclaims any warranties regarding the security, reliability, quality, timeliness, and performance of (i) Lottox, content on Lottox, and Offerings on Lottox; (ii) third-party products or services advertised or received through any links on Lottox; (iii) any information, content, or advice received through Lottox or links provided on Lottox. AARNANEX DIGITAL PRIVATE LIMITED does not warrant that any errors in Lottox will be corrected.
b.  You agree that your use of Lottox and its Offerings is at your sole discretion. AARNANEX DIGITAL PRIVATE LIMITED is not responsible for any consequences arising out of your use of Lottox.
c.  Lottox is provided on an "AS IS" and "AS AVAILABLE" basis. Neither AARNANEX DIGITAL PRIVATE LIMITED nor any third-party service providers are liable for network, technical, or operational difficulties which may result in loss of data, monetary loss, personalization settings, or other interruptions in Lottox features.

17. Personal Information and Data Security

a.  AARNANEX DIGITAL PRIVATE LIMITED may collect, store, use, process, and transfer to third parties information you provide at registration or during use of Lottox, including personal information, in accordance with applicable data protection laws and the Privacy Policy.
b.  For more details on security measures protecting your personal information on Lottox, refer to our Privacy Policy.
c.  Your acceptance of these Terms and use of Lottox constitutes acceptance of the Privacy Policy.

18. Indemnity

a. You agree to defend, hold harmless, and indemnify AARNANEX DIGITAL PRIVATE LIMITED and its licensors, subsidiaries, associates, affiliates, and partners from any losses, costs, expenses, damages, or liabilities arising from (a) your use of Lottox; (b) your breach of any provision of these Terms; or (c) fraud, negligence, willful misconduct, or intentional wrongdoing by you.
b. You shall not settle or compromise any matter without prior written consent from AARNANEX DIGITAL PRIVATE LIMITED. We are entitled to participate in such defense at your cost.

19. Limitation of Liability

To the fullest extent permitted by law, AARNANEX DIGITAL PRIVATE LIMITED is not and will not be liable for any indirect, remote, punitive, special, incidental, consequential, or exemplary damages (including loss of business, revenue, profits, or goodwill) arising from Lottox or the Offerings, even if we have been advised of, or could have foreseen, such damages. This includes damages due to: (a) use or inability to use Lottox; (b) conduct of any User on Lottox; (c) unauthorized access to or alteration of transmissions or data; (d) malicious or criminal behavior; (e) technical or operational lapses. Our liability shall not exceed the price of the Lottery Ticket forming the subject matter of the dispute.

20. Governing Law & Dispute Resolution

This Agreement and your use of Lottox are governed by Indian laws. Parties may seek interim relief at appropriate courts with jurisdiction. For disputes arising from these Terms and use of Lottox, the courts at Mumbai shall have exclusive jurisdiction. AARNANEX DIGITAL PRIVATE LIMITED is not liable for Lottery claims exceeding INR 10,000; such disputes are against the relevant State Government and governed by applicable Lottery Laws.

21. General Provisions

a.  Entire Agreement: These Terms constitute a binding agreement between you and AARNANEX DIGITAL PRIVATE LIMITED and govern your access to Lottox. They supersede prior Terms on Lottox.
b.  Advertisement: AARNANEX DIGITAL PRIVATE LIMITED may place advertisements, including third-party ads, on Lottox.
c.  Binding Nature: This Agreement binds you, AARNANEX DIGITAL PRIVATE LIMITED, and successors or permitted assigns.
d.  Severability: If any provision is held invalid, it does not impair the validity of remaining provisions.
e.  Waiver: Failure to exercise any right does not waive further rights.
f.  Assignment: You may not assign or sublicense rights or obligations without prior written consent. AARNANEX DIGITAL PRIVATE LIMITED may assign or sublicense to affiliates.
g.  Conflict: In case of conflict between these Terms, the Privacy Policy, or other policies, the order of precedence is: (i) Terms, (ii) Privacy Policy, (iii) other policies.

22. Refund & Cancellation

If a transaction is cancelled or unsuccessful and the amount is deducted from the bank account, it will be credited back to the customer's account as per standard banking timelines. Refunds requested by customers will be processed within 7 working days.
